Article 2: APPLICATION OF GENERAL SALES CONDITIONS

These General Sales Conditions govern the commercial relationships between CAVES ST REMY-DESOM Sàrl (the Seller) and any individual non-trader registering as a customer (the Client) on the online sales website www.desom.lu

The General Sales Conditions apply to the sale of all products offered by CAVES ST REMY-DESOM Sàrl via the Site www.desom.lu

Before starting the order process, the Client is invited to familiarize themselves with the General Sales Conditions (GSC) by clicking on "GSC". Placing an order implies the full and unconditional acceptance of these GSC by the Client. The offers on the Site are exclusively reserved for private customers aged 18 or over. Orders are confirmed by sending a confirmation email, but are only final upon receipt of full payment. The Seller reserves the right to occasionally modify its general conditions, which will be valid upon publication.

Product photos are not contractual.

Article 3: PRICES

Prices are per bottle and per unit of packaging indicated for sale. Prices are in Euros (€) and correspond to the prices in effect on the day of the order. Prices are inclusive of VAT (14% for wines, 17% for crémants and spirits, 3% for non-alcoholic beverages) excluding packaging costs, deposits, and delivery charges, subject to typographical error and display or manifest price error.

Article 4: DELIVERY COSTS

Delivery is free for orders exceeding €200 including VAT excluding deposits. A delivery fee of €10 including VAT will be charged for other orders. For deliveries abroad, additional transportation and customs clearance fees will apply. Article 5: DELIVERY

Deliveries of purchases via the Site are limited to addresses in the Grand Duchy of Luxembourg. In case of stock shortage at the delivery of a ordered and paid product, the Client is promptly informed. The Client has the choice between replacing the unavailable item with an item of equivalent quality and price or canceling this item. The refund of payments already made will be made promptly.

The Company cannot be held responsible for any stock shortage or limit.

Deliveries are made by CAVES ST REMY-DESOM or any other delivery service to the delivery address indicated by the Client.

The delivery date is communicated to the Client by telephone and delivery is made during the day between 8 am and 5 pm.

Deliveries are accompanied by a receipt to be signed obligatorily by the Client. By signing this, the Client acknowledges receipt of their order in good condition. In case of absence of the Client at the agreed delivery time, a delivery notice is left at the delivery address. The Company offers a second delivery at the expense of the Client or the possibility to pick up the order at CAVES ST REMY-DESOM in Remich.

Article 6: DELIVERY TIMES

Delivery times start from receipt of payment for the order. In any case, delivery must take place within a maximum period of thirty (30) days.

If delivery could not be ensured within this period, the Client would be informed as soon as possible and could cancel their order. They could then request the exchange of the product or its refund.

Article 7: PAYMENTS

The order is payable in full to CAVES ST REMY-DESOM, from the issuance of the order form on the site, by credit card (secure online payment or communication of the card number, expiration date, and holder by telephone, or mail).

We have implemented a secure procedure for payment by credit card on the Internet for you. This procedure is based on information encryption technology, a true reference for secure payment. Credit card payments are secure via the transaction company WORLDLINE.

How to place an order by credit card on the site?
When making your payment, you enter your credit card number and expiration date which are immediately encrypted on your computer before being sent over the Internet. Thus, no confidential information circulates on the network without having been previously encrypted. Note: only credit cards bearing the CB, VISA, EUROCARD, MASTERCARD logo are accepted..

Article 8: DELIVERY AND LIABILITY

It is the Client's responsibility to check the delivery upon receipt and to make reservations if necessary on the delivery slip provided by the delivery driver. In case of complaint concerning the delivery, the Client has a period of 8 days from the receipt of the goods to notify CAVES ST REMY-DESOM and to provide evidence of the delivery error.

Article 9: RIGHT OF WITHDRAWAL

In accordance with the provisions of the Consumer Code, the Client has a period of 14 days (from the day of delivery) to withdraw from the contract and to return within this period and at their own expense, to the Seller's registered office address indicated in Article 1, the product in good condition and in its original packaging with the original invoice, for exchange or refund of an amount corresponding to the price paid for the returned product. The Client must notify the Company that they are exercising their right of withdrawal either by registered letter or via the website. A withdrawal form is available on the Site. Article 10: CONFIDENTIALITY OF PERSONAL DATA

Article 11: APPLICABLE LAW AND COMPETENT JURISDICTION

These General Sales Conditions are subject to Luxembourg law and all disputes relating to them will be the exclusive jurisdiction of Luxembourg courts.
